Why contact a Notary?
The Notary as a public official: the Notary is a public official established "to receive deeds between living persons and of last will, to give them public faith, to preserve their deposit, to issue copies, certificates and extracts" (art. 1 Ln).
The law also grants the Notary the powers to: file voluntary jurisdiction appeals regarding the stipulations for which he is responsible; receive sworn affidavits; receive declarations of acceptance and waiver of inheritance; prepare inventory reports and reports on the opening of safety deposit boxes; perform acts delegated by the judicial authorities; sign and authenticate commercial books; receive certified documents; and perform any other activity provided for by specific regulations.
The notarial deed has a privileged status, as it "provides full proof, until a complaint of forgery is made, of the document's provenance from the public official who drew it up, as well as of the parties' declarations and of other facts that the public official certifies as having occurred in his presence or performed by him" (art. 2700 of the Civil Code).
Therefore, recourse to a Notary is necessary not only in cases where the public deed form is required by law, but also whenever a deed must (or is desired) be made enforceable against third parties through transcription or registration in public registers.
